As a general rule, this route requires having entered with a visa and through an official port of entry — an inspected, recorded entry. An expired visa does not erase that record: what counts is how the entry happened. If the entry was without inspection, the applicable route is usually consular processing.
When there is a pending asylum case
If someone with a pending asylum case marries a U.S. citizen, a decision appears that cannot be improvised: continue with asylum, adjust status, or withdraw the earlier case. Each path leaves a trace in the forms, and contradictions between files are noticed.
